UK CBAM is a carbon leakage prevention mechanism modeled on the EU CBAM but with rules specific to the UK. From January 1, 2027, businesses importing products into the UK from the aluminum, cement, fertilizer, hydrogen, and iron-steel sectors will incur carbon liabilities for the embedded emissions of the goods they import. Initially, the mechanism will only cover direct emissions; the inclusion of indirect emissions has been postponed to 2029 at the earliest. The glass and ceramics sectors, which were included in the first draft, have been excluded from the scope.
Who Does UK CBAM Apply To?
UK CBAM applies to all businesses importing CBAM-covered products into the UK. Only businesses importing £50,000 or more of CBAM products in a 12-month period are subject to reporting obligations. UK CBAM is of critical importance especially for Turkish iron-steel, aluminum, cement, and fertilizer producers exporting to the UK; because even though the legal obligation lies directly with the importer, the responsibility to provide embedded emissions data falls on the producer. Insufficient or unverified emissions data could lead to the importer being taxed under high default values and put orders at risk.
What is the Scope and Obligations of UK CBAM?
The UK CBAM obligation covers five main sectors with a high risk of carbon leakage:
Iron and steel
Aluminum
Cement
Fertilizer
Hydrogen
Products within scope are determined according to the HS codes under Annex B published by the UK Government. The first accounting period will cover January 1 - December 31, 2027; from 2028 onwards, reporting will be made on a quarterly basis. The CBAM liability is calculated by multiplying the product's embedded direct greenhouse gas emissions by the UK CBAM unit price (referencing the UK ETS price). Any provable carbon price paid in the country of origin is deducted from the total liability.
